제1조 (목적)

본 약관은 JHSmotionlab(이하 "연구소" 또는 "서비스")이 제공하는 웹 기반 야구 AI 분석 서비스(피칭 AI 스튜디오, 배팅 AI 스튜디오, 엘리트 뷰어 등)의 이용과 관련하여 서비스와 이용자 간의 권리, 의무 및 책임사항을 규정함을 목적으로 합니다.

제2조 (용어의 정의)

  1. "서비스"란 연구소가 개발·운영하는 https://www.jhsmotionlab.com 및 하위 분석 애플리케이션 일체를 의미합니다.
  2. "이용자"란 본 서비스에 접속하여 투구 또는 타격 영상을 업로드하거나 샘플 데이터를 통해 분석 결과를 열람하는 모든 방문자를 말합니다.
  3. "AI 분석 리포트"란 컴퓨터 비전 포즈 인식 기술과 기구학 연산을 통해 산출된 5대 핵심 이벤트, 관절 각도, 각속도, 키네마틱 시퀀스 그래프, AI 코칭 권고 사항 등을 포함한 시각화 데이터를 말합니다.

제3조 (서비스의 성격 및 의학적 면책 조항)

본 서비스에서 제공되는 모든 키네마틱 지표, 팔꿈치/어깨 관절 부하 추정치, 스트라이드 및 꼬임각 분석 결과는 선수와 지도자의 스포츠 역학적 이해를 돕기 위한 연구 및 교육용 참고자료입니다.
본 서비스의 분석 결과는 정형외과, 재활의학과 전문의 등의 임상 진단이나 물리치료 처방을 대체할 수 없으며, 통증이나 이상 징후가 있을 경우 즉시 전문 의료기관의 진료를 받아야 합니다.

제4조 (이용자 영상 데이터의 비보관 원칙)

연구소는 이용자의 개인정보 및 초상권을 철저히 존중합니다. 이용자가 업로딩한 투구/타격 동영상 파일은 실시간 포즈 랜드마크 추출 즉시 메모리 및 임시 캐시에서 파기되며, 서버에 영구적으로 보관하거나 제3자에게 제공되지 않습니다. 자세한 사항은 개인정보처리방침을 따릅니다.

제5조 (오픈소스 연구 데이터 인용 및 라이선스)

본 서비스에서 제공하는 프로/엘리트 3D 모션 벤치마크 및 비교 기준 데이터 중 일부는 Driveline Baseball의 오픈 바이오메카닉스 프로젝트(Open Biomechanics Project - OBP) 공개 연구 데이터셋을 기반으로 검증 및 가공되었습니다.

  • 출처 표기: Driveline Open Biomechanics Project (OBP) Pitching & Hitting Datasets.
  • 라이선스 고지: 해당 원천 데이터는 Creative Commons Attribution-NonCommercial-ShareAlike 4.0 International (CC BY-NC-SA 4.0) 라이선스를 준수하며, 연구·학술적 비교 분석 목적으로 인용됩니다.

제6조 (지식재산권 및 서비스 이용 제한)

  1. 서비스 내 모든 UI 디자인, 알고리즘 연산 엔진, 시각화 인터페이스, 기술 문서 및 캐릭터/로고의 지식재산권은 연구소에 귀속됩니다.
  2. 이용자는 비상업적 목적으로 본인의 분석 리포트 및 요약 카드를 저장, 인쇄, 공유할 수 있습니다.
  3. 이용자는 자동화된 봇(Bot), 크롤러, 스크래핑 도구를 활용하여 서비스 인프라에 비정상적인 트래픽 부하를 유발하거나 역공학(Reverse Engineering)을 시도할 수 없습니다.

제7조 (온라인 광고 및 제휴 서비스)

본 서비스는 지속 가능한 무료 바이오메카닉스 분석 환경을 제공하기 위해 제3자 광고(Google AdSense 및 파트너사 제휴 배너)를 게재할 수 있습니다. 광고 링크를 통해 이동하는 외부 웹사이트에서 발생하는 거래나 분쟁은 해당 제3자와 이용자 간의 관계이며 연구소는 이에 대해 책임을 지지 않습니다.

제8조 (준거법 및 관할)

본 약관은 대한민국 법령에 따라 규율되고 해석되며, 서비스 이용과 관련하여 발생한 분쟁에 대해서는 연구소 소재지를 관할하는 법원을 전속 관할법원으로 합니다.

1. Purpose and Acceptance

These Terms of Service ("Terms") govern your access to and use of the baseball AI analysis applications (AI Pitching Studio, AI Hitting Studio, Elite 3D Viewer) operated by JHSmotionlab ("we", "us", or "the Service"). By accessing or using our Service, you agree to be bound by these Terms.

2. Definitions

  • "Service" refers to the website https://www.jhsmotionlab.com and its affiliated motion analysis endpoints.
  • "User" refers to any visitor who accesses the site, uploads pitching/hitting videos, or interacts with benchmark motion data.
  • "Analysis Report" refers to visual and numerical kinematics data generated by our algorithms, including key phase events, joint angles, angular velocities, kinematic sequence curves, and coaching feedback.

The Service is NOT a medical device, nor does it provide clinical diagnosis or physical therapy prescriptions. If you experience joint pain, elbow/shoulder discomfort, or injury symptoms, please consult a qualified healthcare provider immediately.

4. Video Privacy and Zero-Retention Policy

We respect your privacy. User-submitted video files are processed in real-time strictly to compute anatomical landmarks. All temporary video files and cache representations are permanently deleted immediately after computation is completed. We do not retain, distribute, or sell user video media. 5. Open Source Research Attribution & Driveline OBP

Certain elite benchmark kinematics and 3D reference curves featured in our Elite Viewer are processed and referenced from the Driveline Baseball Open Biomechanics Project (OBP) public dataset.

Automated crawling, scraping, or malicious denial-of-service attempts against our infrastructure are strictly prohibited.

7. Advertising & Third-Party Sponsorship

To sustain free and accessible biomechanics tools for athletes worldwide, our Service may display third-party advertisements (such as Google AdSense) and sports sponsorship placements. JHSmotionlab does not endorse or assume liability for third-party products, services, or transactions conducted through external advertising links.

8. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of Korea, without giving effect to any principles of conflicts of law.
